If you do not agree to these terms, do not install or use the Software. 1. LICENSE GRANT ---------------- Upon purchase of a valid license, you are granted a non-exclusive, non-transferable license to use the Software on the number of websites specified by your license: - Pro License: 1 website 2. LICENSE PERMANENCE AND NON-TRANSFERABILITY ---------------------------------------------- a) LICENSE BINDING: Each license key is permanently bound to the domain on which it is first activated. Once activated, a license CANNOT be transferred, moved, or reassigned to a different domain under any circumstances. b) NON-TRANSFERABLE: Licenses are strictly non-transferable. You may NOT: - Transfer your license to another person or entity - Sell, resell, or sublicense your license - Move your license to a different domain after activation - Share your license key with any third party c) DOMAIN CHANGE: If you need to use the Software on a different domain, you must purchase a new license. No exceptions, credits, or refunds will be provided for domain changes. d) PERMANENT ACTIVATION: License activation is final and irreversible. By activating your license, you acknowledge and accept that the license is permanently bound to that specific domain. 3. PROHIBITED USES (PIRACY DEFINITION) -------------------------------------- The following activities constitute software piracy and are strictly prohibited: a) Sharing, distributing, or publishing your license key to any third party. b) Using a single license key on more domains than permitted by your license. c) Modifying, reverse engineering, or circumventing any license validation or protection mechanisms within the Software. d) Redistributing the Software, whether modified or unmodified, through any means including but not limited to: file sharing sites, torrent networks, nulled plugin repositories, or other download platforms. e) Using license keys obtained through unauthorized means, including but not limited to: key generators, cracked versions, or keys shared by others. f) Removing or altering any copyright notices, license checks, or attribution within the Software. g) Attempting to reset, transfer, or reactivate a license on a different domain than originally activated. 4. CONSEQUENCES OF VIOLATION ---------------------------- Any violation of these terms may result in: a) Immediate and permanent revocation of your license without refund. b) Termination of access to all support and updates. c) Legal action to recover damages, including but not limited to: - The retail value of licenses for each unauthorized installation - Legal fees and court costs - Statutory damages where applicable under copyright law 5. INTELLECTUAL PROPERTY ------------------------ The Software, including all code, design, documentation, and associated materials, is the intellectual property of Sia Nomad Group and is protected by copyright law and international treaties. 6. WARRANTY DISCLAIMER ---------------------- THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. 7. LIMITATION OF LIABILITY -------------------------- IN NO EVENT SHALL SIA NOMAD GROUP BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SOFTWARE. 8. API USAGE AND THIRD-PARTY SERVICES ------------------------------------- The Software integrates with third-party AI services (OpenAI, Groq). You are responsible for: a) Providing your own API keys for these services. b) Complying with the terms of service of these third-party providers. c) Any costs incurred from API usage with these providers. 9. DATA AND PRIVACY ------------------- The Software processes images through external AI APIs. By using the Software, you acknowledge that image data will be transmitted to third-party AI providers for processing. No personal data is collected or stored by Sia Nomad Group. 10. NO REFUNDS -------------- Due to the digital nature of the Software and the permanent binding of licenses, ALL SALES ARE FINAL. No refunds will be provided under any circumstances, including but not limited to: - Change of domain or hosting provider - Dissatisfaction with the Software - Failure to read these terms before purchase - Technical issues on your end 11. UPDATES AND MODIFICATIONS ----------------------------- Sia Nomad Group reserves the right to modify these terms at any time. Continued use of the Software after such modifications constitutes acceptance of the updated terms. 12. GOVERNING LAW ----------------- These terms shall be governed by and construed in accordance with applicable international copyright law and the laws of the jurisdiction in which Sia Nomad Group operates. 13.
