# glitchGL Software Licence

This is a legal agreement between you and NaughtyDuk for the use of the glitchGL software ("the Software"). By using the Software, you agree to these terms.

## 1. Personal Use Licence

You are granted a free, non-exclusive licence to use the Software for any personal, non-commercial projects.

- **Permitted Use Includes:** Personal portfolios, personal websites, academic projects, and open-source projects that are not monetised or commercially backed.
- **Prohibited Use Includes:** Any project that generates revenue, is for a for-profit business (including LLCs, corporations, etc.), or is part of a product or service that is sold, re-sold, or monetised in any way.

## 2. Commercial Use Licence

A paid licence is required for any commercial use of the Software.

- **Single Project Licence:** Allows use in one (1) commercial project/website.
- **Studio Licence:** Allows use in up to five (5) commercial projects/websites.

## 3. Modification and Distribution

#### a. No Redistribution

The Software, in whole or in part, may not be resold, sub-licensed, or redistributed in any form, whether for free or for a fee. This includes offering the Software as part of a stock asset, template, or on any platform that facilitates the distribution of digital assets.

#### b. Permitted Modifications

You are permitted to modify the Software to integrate it into your own personal or commercial projects, subject to the licensing terms above. However, these modifications do not grant you the right to redistribute or resell the modified Software, in whole or in part.

#### c. Prohibited Actions

You may not:

- Include the Software in a website builder, template, or any product that is sold or distributed to multiple customers.
- Create a derivative software product, framework, or library using the Software or its components for the purpose of redistribution or resale.
- Rebrand or "white-label" the Software as your own.

#### d. Ownership of Modifications

While you retain ownership of any original code you write to extend or modify the Software, the underlying Software remains the property of NaughtyDuk and is subject to the terms of this licence.

## 4. Disclaimer of Warranty

**THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.**
