End-User License Agreement (EULA) for the PimaOnline ThemePack

IMPORTANT: PLEASE READ THIS END-USER LICENSE AGREEMENT CAREFULLY BEFORE USING [APP NAME].

This End-User License Agreement (EULA) is a legal agreement between you (either an individual or a single entity) and Pima Community College for the PimaOnline ThemePack software product(s) identified above, which may include associated software components, media, printed materials, and online or electronic documentation (the "Software").

By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Software.

1. GRANT OF LICENSE.
The Software is licensed, not sold. Pima Community College grants you a non-exclusive, non-transferable license to use the Software on any device that you own or control.

2. COPYRIGHT.
All title and intellectual property rights in and to the Software (including but not limited to any images, photographs, animations, video, audio, music, text, and "applets" incorporated into the Software), the accompanying printed materials, and any copies of the Software are owned by Pima Community College or its suppliers. The Software is protected by copyright laws and international treaty provisions. Therefore, you must treat the Software like any other copyrighted material.

3. RESTRICTIONS.
You may not reverse engineer, decompile, or disassemble the Software except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation. You may not rent, lease or lend the Software. You may not copy the printed materials accompanying the Software.

4. TERMINATION.
Without prejudice to any other rights, Pima Community College may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the Software in your possession.

5. NO WARRANTIES.
Pima Community College expressly disclaims any warranty for the Software. The Software is provided 'As Is' without any express or implied warranty of any kind, including but not limited to any warranties of merchantability, non-infringement, or fitness of a particular purpose. Pima Community College does not warrant or assume responsibility for the accuracy or completeness of any information, text, graphics, links or other items contained within the Software. Pima Community College makes no warranties respecting any harm that may be caused by the transmission of a computer virus, worm, time bomb, logic bomb or other such computer program. Pima Community College further expressly disclaims any warranty or representation to Authorized Users or to any third party.

6. LIMITATION OF LIABILITY.
In no event shall Pima Community College be liable for any damages (including but not limited to lost profits/business interruption/loss of information) arising out of 'Authorized Users' use of or inability to use the Software even if Pima Community College has been advised of the possibility of such damages.

7. GOVERNING LAW.
This EULA shall be governed by the laws of United States/Arizona.
